General Terms and Conditions of Sales
Preliminary clause
The retail website www.repetto.com (hereinafter the "Site") is an e-commerce website accessible via the internet, open to any user of this network (hereinafter referred to as "internet user"). It is published by the company Repetto Retail (hereinafter "Repetto"), an SARL with capital of 1 000 Euros, registered office address : 30 avenue de Messine - 75008 Paris, registered with the Trade and Companies Register of Paris under number 493 441 224.
It is stated that items are reserved for individuals and for the personal use of the Customer, which is unrelated to any business use by the Customer. As such, the Customer's attention is drawn in particular to the fact that the value of their orders shall not exceed the sum of € 1 000. These General Terms and Conditions of Sale are restricted solely to consumers within the meaning of the law and case law, who are acting exclusively on their own behalf and residents in Metropolitan France (including Corsica). In accordance with Articles L 111-1 and L 113-3 of the Consumer Code, the essential features and prices of our products sold online are available at www.repetto.com or Repetto brand name outlets. In addition, the Customer receives the information referred to in Articles L 121-18 and L 121-19 of the Consumer Code before and after the conclusion of the sale and including via these General Terms and Conditions of Sale, which the Customer declares having read, before confirming their order and which are available from the website www.repetto.com. Repetto reserves the right to change these General Terms and Conditions of Sale at any time by publishing a new version on the website. The General Terms and Conditions of Sale are those which are current on the date the order is placed.
Clause 1 – Scope of application
These General Terms and Conditions of Sale apply to all sales of Repetto items concluded either through the Customer Services Department of the online shop set up by Repetto, or via the retail website accessible from the French version of the website www.repetto.fr and www.repetto.com, for delivery in Metropolitan France (including Corsica).
1.1. With regard to online selling (internet), the customer declares to have read these General Terms and Conditions of Sale before placing the order. Confirmation of their order implies acceptance without restriction or reserve of these General Terms and Conditions of Sale.

Clause 3- Price of items and conditions of validity
The price of products sold on the www.repetto.com website is indicated per item and product reference and includes all taxes (VAT) plus delivery. Upon confirmation of the order, the price to be paid by the Customer means the all-inclusive price, the sum of the price inclusive of VAT for the items that make up the order plus delivery charge. Telecommunication costs associated with gaining access to the website will be paid by the Customer. The conditions of validity for our product offerings and prices are determined by updating the website when our collections or our promotions are launched and will remain applicable as long as they remain accessible.
Clause 4. Ordering of goods / Stages of completion of sale
1. Go to the address www.repetto.com
2. Follow the website instructions.
3. Follow the required instructions to open a customer account.
4. Complete the order form.
5. Review the items in your order, identify and correct any errors made when typing.
6. Confirm the order, the total price and the price including VAT by clicking Pay for your order to pay.
7. Follow the instructions of the payment server of our partner savings bank to pay for your Repetto order. Your bank account is debited for the price including VAT including the total price of items despatched and delivery charge.
8. You receive acknowledgment by e-mail as confirmation of your order.
9. You receive an e-mail confirming that your order has been despatched.
10. You receive your package at the shipping address you provided when ordering.
When you complete your account opening form, provide personal data and your bank card number related and confidential data, the Customer is required to comply with these contractual terms and conditions pursuant to Article 1316-1 of the Civil Code.
In accordance with the provisions of Article L.122 1 of the Consumer Code, Repetto shall have the right to refuse any unusual order or order placed in bad faith or for any other legitimate reason. In addition, Repetto shall have the right to refuse any order from a Customer with whom there is a dispute over payment of a previous order. Clause 5 - Terms of payment – Secure payment;
Customer purchases will be paid for by bank card only: the following debit / credit cards are accepted: "CB" network, Visa, and Eurocard / Mastercard issued for bank accounts domiciled in Metropolitan France (including Corsica).
As an order will only be confirmed only if the product(s) is / are available, the transaction will be immediately debited from the customer's debit / credit card after verification of their data, upon receipt of debit authorisation from the company issuing the debit / credit card used by the customer.
In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the undertaking to pay using a payment card is irrevocable. By providing their debit / credit card number and the above-mentioned information, the customer authorises the company AMB to debit their debit / credit card for the total amount including VAT for their order (delivery included).
For this purpose, the customer confirms that they are the holder of the debit / credit card to be debited and that the name on the debit / credit card to be debited is theirs, then, in a secure environment on the website of our payment partner BNP Paribas, provides the sixteen digit number and expiry date appearing on the front of their debit / credit card and, where required, the security code number on the back of their debit / credit card.
In the event, for any reason whatsoever, that any sums payable by the customer cannot be paid, the sale will be immediately cancelled automatically and the purchasing process electronically cancelled.
Ogone is alone to have knowledge of the banking information of the customer thanks to her secure space. This information passes in transit in no way on the site to www.repetto.fr.
To fight against the fraud on the Internet, the Repetto Retail company chose to use the 3D Secure system set up by financial institutions since January 1st, 2009.
Payments made by debit / credit card over the Internet have used 3D-SECURE since 1st October 2008. Additional information known to the bank and the cardholder is requested during a transaction. This helps to strengthen the authentication of its customers for payments on the internet.This authentication verifies that the card is being used by its legitimate owner.
Specifically, when making a payment on a retail website with the "MasterCard Secure Code" and "Verified by Visa" logos, a new window appears asking for personal information of the payer. This may be the birth date of the card holder or a secret code depending on the internet user’s bank (1). This data entry control verifies that the internet user making the payment is the person associated with the card used.
This authentication is mandatory and any refusal to enter this personal information or any mis-typing of this personal information of the payer will result in cancellation of the transaction.
Clause 6. Despatch and Delivery
When entering the order, the customer must choose the delivery method offered on the retail website (Colissimo or TNT) and place of delivery. In all cases, the place of delivery will be situated in Metropolitan France, including Corsica..Any delivery address situated outside this area will be refused during the ordering process.The customer may request that items ordered be delivered to their home or office, to a third party, place of holiday, etc. The customer also has the option to have items delivered to a person of their choice. Delivery charges are calculated on the basis of order amount and the delivery service chosen:

TNT express delivery is guaranteed for orders placed before 10 am - french hours, excluding weekends and holidays, subject to confirmation of payment, we will prepare your order in the afternoon and hand it to TNT in late afternoon. TNT then guarantees delivery in Metropolitan France, including Corsica, within 24 hours following receipt, excluding weekends and holidays.
When a parcel leaves the Repetto warehouse to be sent to the address specified by the customer when the order was placed, the customer receives an email from the www.repetto.com confirming despatch, with a tracking number for their parcel. The customer can track the status of their order in a secure personal area, YOUR ACCOUNT, which can be accessed on the wwww.repetto.com website, providing the tracking number for the parcel, or on the websites provided by Colissimo : http://www.coliposte.net for the Colissimo delivery or TNT: http://www.tnt.fr for the TNT delivery. The customer will be responsible for checking the items upon delivery and to make any reservations and complaints which seem justified, or even refuse the parcel if it is likely to have been opened or if there are clear signs of damage. Any reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within 3 working days, excluding holidays, following delivery of the products, and a copy will be immediately sent to the Repetto. If no complaint is received within said period, no action may be taken against the carrier in accordance with the provisions of Article L 133-3 of the Commercial Code.The customer must ensure that the items delivered match their order. In the event that the items delivered do not conform in type or quality with the specifications on the delivery note, the customer must telephone the Repetto e-shop Customer Services Department and return the items to the address and under the conditions specified in Clause 8.
Clause 7. Money back guarantee – Right of cancellation and return of items
Repetto agrees that customers who are not satisfied with the items ordered can exercise their right of cancellation as set out in Article L.121-1 of the Consumer Code under optimum conditions.The customer may return the items delivered within seven days of the date of delivery, in their original packaging, complete (accessories, instructions, shoe box, plastic covers, etc.), labelled, new, unworn, unwashed and accompanied by the return slip (with your order) carefully completed and a copy of the delivery note, to the following address:

Beyond this seven day period, no returns will be accepted.It is the responsibility of the customer to provide proof of this return, which assumes that the items must be returned by registered mail, or by any other means giving a certain date, and the costs and risk will be assumed by the customer. If the conditions above are met and once the goods are received, checked and accepted by us, Repetto will refund the returned items at the price charged (shipping included), by the method of payment for the items, by crediting the customer's bank account corresponding to the debit / credit card used for payment or by transfer to the customer's bank account within thirty days of receipt by the Repetto Retail company, of the returned items. Items returned incomplete, spoiled, damaged or soiled by the customer will not be refunded. It is specified that the use of the Gift Service and the right of cancellation is for the exclusive benefit of the customer and in no case be exercised by the gift recipient. As this is an online sale, no return, exchange or refund of any kind can be processed in-store.

Clause 8. Warranty and liability
The products sold on the www.Repetto.com website are subject to terms of legal guarantees set out in Articles L 211-4, L 211-5 and L 211-12 of the Consumer Code and by Articles 1641 and 1648 of the Civil Code:
The responsibility of the company Repetto Retail cannot be held:
1.1. in case of breach of contractual obligations because of a fortuitous event or force majeure ;
1.2. in case of non-essential differences between the photos, text and illustrations of items on our site and the items ordered.
Clause 9. Complaints
For any information, complaint or question concerning the mail order terms and conditions established by Repetto, customers should contact the Repetto e-shop Customer Services Department at the following address: Repetto – Online store Customer Services Department - 465 rue Fourny, 78350 Buc - France or by email to the following address: eshopserviceclient@repetto.com, quoting in both cases the reference number and date of the order. As this is online selling, no complaint of any kind can be processed in-store. Only enquiries relating to purchases made via the Repetto e-shop will be considered. Clause 10. Confidentiality of data
Repetto manages an electronic file which holds certain personal data about its customers. When an order is placed on the www.repetto.com website by new customers, this database is updated with information about them, which will, thereafter, enable us to better meet their expectations and facilitate assistance services provided by the e-shop Customer Services Department. This database has been the subject of a declaration pursuant to the provisions required by law relating to Data Files and Individual Liberties of 6 January 1978, amended by Act of 6 August 2004. Depending on the options made when creating or consulting their online accounts, customers are likely to choose whether to receive offers from Repetto brand name. The "Repetto" brand name, and all other trademarks, whether figurative or otherwise and generally all other trademarks, illustrations, images and logos on Repetto items, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of Repetto. Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and in any medium whatsoever, is strictly prohibited without the prior express agreement of Repetto. This is also applicable to any combination or conjunction with any other trademark, symbol, logo and more generally any distinctive sign intended to form a composite logo. This is also applicable to all copyright, designs, models and patents, which are the property of Repetto.
Clause 11. Force majeure
The performance by Repetto of all or part of its obligations shall be suspended upon the occurrence of a fortuitous event or force majeure which impedes or delays performance. The following are considered as such, in particular, but not limited to: war, riots, insurrection, civil unrest, strikes of all kinds and supply problems experienced by Repetto. Repetto will inform the customer of such fortuitous event or force majeure within seven days of its occurrence. If this suspension continues beyond a period of fifteen days, the customer will have the option to cancel the order in progress, and will then be refunded under the conditions set out in Article 8 of these general terms and conditions of sale.
Clause 12. Disputes – Applicable law
These General Terms and Conditions of Sale are subject to French law. In the event of any difficulty arising in connection with an order or delivery of Repetto items, the customer will have the opportunity, before taking any legal action, to seek an amicable solution, particularly with the assistance of a consumer organization or any other form of advice of their choosing. Any disputes which may arise from the interpretation or performance of these General Terms and Conditions of Sale and subsequent documents will be subject to the exclusive jurisdiction of the French courts.
